User Terms of Service

Thank you for using Applied Humanity Inc.’s product, Parafoil (“Applied Humanity,” “Parafoil,” “we,” “our”, or “us”) and our website at https://parafoil.co, along with our related websites, hosted applications, macOS and Windows applications or other downloadable applications, and other services provided by us (collectively, the “Service”). These User Terms of Service are a legally binding contract between you and Applied Humanity Inc. regarding your use of the Service.

PLEASE READ THESE TERMS CAREFULLY:

BY SIGNING UP OR REGISTERING WITH PARAFOIL OR FOR ANY SERVICE, OR BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS, INCLUDING OUR PRIVACY POLICY (TOGETHER, THESE “TERMS”). IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE, AND YOU SHOULD NOT USE, ANY SERVICE. YOUR USE OF THE SERVICE, AND PARAFOIL’S PROVISION OF THE SERVICE TO YOU, CONSTITUTES AN AGREEMENT BY PARAFOIL AND BY YOU TO BE BOUND BY THESE TERMS.

1. Service Overview

Applied Humanity Inc. provides Parafoil, an application designed to help you enhance your leadership skills by analyzing leadership activities, such as emails, calendar entries, and meetings.

2. Eligibility

You must be at least 18 years old to use the Service. If you are under the age of 18, you may not use the Service unless you have received permission from your guardian or are using the Service through an organization that has authorized your use.

3. Accounts and Registration

To use Parafoil, you may be required to create an account. By creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

If you believe that your account is no longer secure, you must immediately notify us at support@parafoil.co.

4. Payment and Fees

Some features of the Service may require payment. Before you are charged for any paid features, you will have an opportunity to review the fees and agree to them. All fees are non-refundable except as otherwise provided.

5. Use of the Service

• Upload content that is harmful, threatening, defamatory, or obscene.
• Interfere with or disrupt the Service or the servers connected to the Service.

• Any claim that your User Content infringes on the intellectual property rights of others.

12. Disclaimers and Limitation of Liability

THE SERVICE AND ALL CONTENT PROVIDED ON THE SERVICE ARE OFFERED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT WILL APPLIED HUMANITY INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE FEES PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which Applied Humanity Inc. is based, without regard to its conflict of law principles.

Any disputes arising under or in connection with these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in the jurisdiction where Applied Humanity Inc. is based.

14. Modifications to the Service and Terms

We may modify the Service, these Terms, or any policies from time to time. You will be notified of any material changes to these Terms by email or through the Service. Continued use of the Service after such changes will constitute your acceptance of the updated Terms.

15. Privacy and Data Protection

By using the Service, you agree to our Privacy Policy, which explains how we collect, store, and protect your data. We take your privacy seriously and will only share your data as necessary to provide the Service or as required by law.

17. Miscellaneous

No failure to enforce any part of these Terms will be considered a waiver of our right to do so.
